9. EMINENT DOMAIN. The taking of a portion of a unit
or of the comanon e ements by eminent domain shall be deemed
to be a casualty, and the awards for such taking shall be
deemed to be proceeds from insurance on account of the
casualty~ and shall be deposited with the Insurance Trustee.
Even though the awards may be payable to the unit owners,
the unit owners shall deposit the awards with the Insurance
Trustee; and, in the event of failure to do so~ in the
discretion of the Board of Directors of the Association, a
special assessment shall be made against a defaulting unit
owner in the amount of his award, or the amount of such
award shall be set off against the sums hereafter made
payable to such owner. The proceeds of the awards shall be
distributed or used in the manner heretofore provided for
insurance proceeds.
10. USE RESTRICTIONS. The use o£ the property of the
condominium sha 1 be in accordance with the following provisions:
10.1 Units. Each of the units shall be used only
for the cultivation of citrus crops and for no other purposes.
No unit may be divided or subdivided into a smaller unit nor
any portion thereof otherwise altered without first amending
this Declaration to show the changes in the units to be
affected thereby.
10.2 Comanon Elements, The comanon elements shall
be used only for t e purposes or which they are intended in
the furnishing of services and facilities for the servicing
maintenance and operation of the units.
11. TRANSFERS SUBJECT TO APPROVAL.
a. Sale. No unit owner-may dispose of a
unit or any interest therein by sale without approval
of all unit owners of record.
b. Lease. No unit owner may dispose of a
unit or any interest therein by lease without approval
of all unit owners of record.
c. Gift. If any unit owner shall acquire
his title by gi~t, the continuance of his ownership of
his unit shall be subject to the approval of all unit
owners of record.
d. Mortgage. No unit owner may mortgage
a unit or any interest therein without approval of all
unit owners of record.
e. Devise or Inheritance. If any unit
owner acquires is tit e y any manner not hereto~ore
considered in the foregoing subsections, the continuance
of his ownership of his unit shall be subject to the
approval of all unit owners of record.
11.1 Approval by All Unit Owners of Record. The
approval of all unit owners o recor w ic is required for
the transfer of ownership of units shall be obtained in the
following manner:

(1) Sale. A unit owner intending to
make a bona fide sale of his unit or any interest
