GRANTOR, furthermore, does hereby qrant, barqain and sell
unto GRANTEE~, their heirs and assiqns, a permanent,
non-exclusive easement for the purposes of inqress and egress
and construction and maintenance of a dike, drainaqe canal and
road on and over the following described land situate in St.
Lucie County, Florida:
The North Twenty (20) feet of Section 13, Township 34
South, Range 3~ East; and
The East Sixty (60) feet of the North 1/2 of Section 13,
Township 34 South, Range 37 East.
SUBJECT TO: an~ and all (i) zoninq, building, land use or
other laws, ordinances, rules and regulations, and (ii)
easements, rights of way, restrictions, reservations,
encwnbrances, conditions, agreements, leases or other
matters of record.
GRANTOR hereby covenants with the GRANTEE that, except as
noted above, at the time of the delivery of this Special
Warranty Deed, the premises first described above were free from
all encumbrances made by it, and that it will warrant and defend
the same against the lawful claims and demands of all persons
claiming by, through or under it, but against none other;
provided, however, GRANTOR'S liability pursuant to the covenants
given herein shall not exceed, in the aggregate, the amount of
Five Hundred Ninety Thousand Dollars ($590,000.00).
IN WITNESS WHEREOF, GRANTOR has caused this Special
Warranty Deed to be executed'by its duly authorized officers and
its corporate seal to be affixed hereto, all as of the day and
year first written above.
