HomeMy WebLinkAbout1394 INDEBTEDNESS SECURED This Mortqage is given to secure the payment of the indebtedness of the MORTGAGOR now or hereafter owing to the MORTGAGEE under a certain Promissory Note of even date herewith of which the following is a true copy: "PROMISSORY NOTE $472,000.00 December 2~, 1980 FOR VALUE RECEIVED, BARNETTE E. GREENE, JR., and HARIOT H. GREENE, having an address of 4855 16th Street, Vero Beach, Florida (the "Maker") hereby jointly and severally promise to pay to the order of Rebus, Inc., a Delaware corporation (the "Payee"), at P.O. Box 391, Ashland, Kentucky 41101 or such other place or places as the Payee or holder hereof may desiqnate in writing, from time to time, the principal sum of Four Hundred Seventy Two Thousand Dollars ($472,000.00), in lawful money of the United States, toqether with interest accruing thereon from the date hereof at the rates and times hereinafter provided. The principal amount of this Promissory Note shall be paid in one installment of Four Hundred Seventy Two Thousand Dollars ($472,000.00~ on the fourth anniversary of the date hereof. Interest on the principal amount of this Promissory Note from time to time outstandinq shall be paid on the first, second, third and fourth anniversaries of the date hereof at a rate equal to l0y per annum. Interest shall be computed on the actual number of days elapsed on the basis of a 365 or 366 day year, as the case may be. If any principal or interest on this Promissory Note, whether by acceleration or otherwise, falls due or payable on a Saturday, Sunday or public holiday at the place of payment, then such due date shall be extended to the next succeeding business day at the place of payment with interest payable on such business day for the additional nwnber of days elapsed. This Promissory Note is secured by a Purchase Money Mortgage of even date herewith covering certain property situate in St. Lucie County, Florida. In the event the Maker shall default in the payment of any interest or principal hereunder on the date such payments are due, the Payee or holder of this Promissory Note may elect to declare, and may declare, the entire unpaid principal amount hereof, toqether with interest accrued thereon, immediately due and payable. No delay or omission on the part of the Payee or an~ holder in exercising any right hereunder shall operate as a waiver of such right or any other right under this Promissory Note. A waiver on any one occasion shall not be construed as a bar to or waiver of any such right or remedy on any future occasion. In addition to the other sums herein specified, the Maker shall pay on demand all costs of cdllection and attorney's fees incurred or paid by the Payee or any holder in enforcing this Promissory Note when the same has become due, whether by acceleration or otherwise. -2- BO~1K 345 Pact 1392 ~ - -Y__~__ ~
