HomeMy WebLinkAbout1398payment of taxes, insurance premiums and other charges due hereunder, or in reduction or the indebtedness secured by this Mortgaqe; and the rents, issues and profits are hereby specifically pledged to the payment of said indebtedness and of all other obliqations which may accrue under the terms hereof, and MORTGAGEE'S acts, as authorized in this paragraph, shall not in any way affect its right of foreclosure, its right to have a receiver appointed, or its exercise of any other rights provided herein. If any proceedings shall be brought to foreclose the Mortgage or to collect the indebtedness hereby secured, the court having jurisdiction of the case may, upon application at any time by MORTGAGEE during the pendency of said proceedings, without regard to the adequacy of the security, appoint a receiver to take possession of the Premises, protect and preserve the property, and to rent the same, to collect all rentals and profits accruing therefrom and to apply the receipts, as the court may order, in payment of receivership and foreclosure costs, taxes, insurance premiums, property maintenance and all indebtedness hereby secured. if any of said defaults be made in the performance or observance of any of the said agreements, conditions, covenants or warranties herein contained on thE part of the MORTGAGOR to be performed or observed, or in the event of default by the maker of said note, then upon said default, in addition to the remedies heretofore set forth, MORTGAGEE shall have all the rights and remedies provided by law and equity including, but not limited to, the right to take possession of the Premises and sell the same in the manner permitted by the laws of the State of Florida and shall apply all amounts received from the sale toward the payment of the expenses of such repossession and sale and the indebtedness secured hereby.
