ORDER ON MOTION FOR SUMNlARY ~ JUDGMENT,
CONTINUANCE AND LEAVE TO FILE THIRD PARTY COMPLAINT
THIS CAUSE heard by the Court on December 16, 1980 upon
Defendant's motion for summary judgment, and oral motion for
continuance and leave to file third party complaint, and the
court having reviewed the motions, pleadings and cases, and having
heard argument of counsel and being otherwise duly informed in
the premises it is ordered and adjudged that:
1. Defendant's motion for summary judgment is hereby denied.
2. Defendant's oral motion for continuance is hereby granted.
This case is removed from the jury trial docket scheduled for
January 5, 1981. The pre-trial conference scheduled for December
23, 1980 is also cancelled to be rescheduled upon the filing of any
future notice for trial. The lawsuit is continued for a period of
thirty (30) days from the date of this order after which time it
can be renoticed for trial by any party.
3. Defendant's oral motion for leave to file a third party
complaint against Tropicana Pools, Inc. is hereby granted, and
Defendant shall have twenty (20) days from the date of this order
to file said.third party complaint.
