WITNESSETH• That Grantor, for and in consideration of the sum of TEN (t10.00) DOLLARS and other good and valuable consideration paid by Grantee, the receipt of which is hereby acknowledqed, has granted, bargained, and sold to Grantee and Grantee's heirs and assigns forever the following described real property situated, lying and being in St. Lucie County, Florida, to wit: The Condominium Parcel knov+m as Apartment 1012C of Phase X1 of HIGH POINT OF FORT PIERCE CONDOMINIUM SECTION II (the "Condominium") according to the Declara- tion of Condominium thereof, recorded in Offfcial Records Book 304 at Pages 1396 through 1508 of the Public Records of St. Lucie County, Florida as such Declaration may have been amended by any amendments thereto hereto filed in the Public Records of St. Lucie County, Florida including, but not limited to, any amendment to add the aforesaid Phase to the Condominium (if such Phase be other than Phase I thereof). Grantee, by acceptance hereof , and by agreement with Grantor hereby expressly assumes and agrees Lo be bound by and to comply with all of the covenants, terms, conditions and provisions set forth and contained in the aforedescribed Declaration of Condominium, including, but not litnited to, the obligation to make payment of assessments for the maintenance and operation of the Condoininium which may be levfed against the above described Apart- ment. Grantee expressly acknowledges the existence ~ of a Settlement Stipula- tion and Agreement for and Grant of Easements and Other Rights (the "Settle- ment Sdpulation" ) and a Declaration of Protective Covenants and Restrictions (the "Protective Covenants" ), as hereinafter set. forth . The Settlement Stipu- lation provides for this Condaminium to be served by certain facilities of High Foint of Fort Pierce Condominium Section 1 and the Protecttve Covenants Z provides for certain land use covenants upon the land area~ described therein ~including, but not llmited to, portians of the land areas included within this Condominium) and provides for certain drainage easements and other ease- menis and rights including , but not limited to, the "Roadway Easement" , "Sewage System Rights" ,"Water System Riqhts" and "Future Development~ Property Drainage Easement", all as are more particularly described therein, all in addition to the other matters set forth in the Settlement Stipulation and Protective Covenants, which other matters include, but are not limited to, the obligation to pay certain "Assessments" as are respectively set forth in the Settlement Stipulation and Protective Covenants . Grantee expressly acknowl- edges and assumes the obligation to pay the amounts assessed against the Apart~nent under both the Settlement Stipulation and Protective Covenants and acknowledges that "Assessments" under both the Settlement Stipulation and Protective Covenants against all properties now or hereafter included within THIS IBSY'~ PR~ARKD SY: HQR?01i A .
