and the party of the second part shall forfeit all payments made an this
contract; and such payments shall be retained by the said parties of the
first part in full satisfaction and liquidation of all damages by them
sustained, and said parties of the first part shall have the right to
re-enter and take possession of the premises aforesaid without being liable
to any actio~ therefor, and at the optian of the parties of the first part
the unpaid balance shall without demand became due and payable, and all
costs and expenses of collection of said moneys by foreclosure or
otheiwise, including solicitor's fees, shall be paid by the party of the
second part, and the same are hereby secured.
IT IS I~ATIUALLY AG'R~D, by and betw~een the parties hereto, that
the time of payment shall be an essential part of this cvntract, and that
all covenants and agreements herein contained shall extend to and be
obligatory upon the heirs, executors, administrators and assigns of the
respectiv~e par"ties.
'Ifiis contract is nantransferrable without written consent of the
parties of the first part.
Wherever used herein, the term "party" st~all include the heirs,
ti
personal representatives, successors and/or assigns of the respective
parties hereto; the use of the singular n~IInber shall include the plural
and the plural the singular; the use of any gender shall include all
genders; and, if used, the term "note" shall include all the notes herein
described if more than one.
