HomeMy WebLinkAbout2283prior to entry of a judgment e~forcing this Mortgage i(: (a) Borrower pays l.e~der all sums which would bc then due under this I-fortgage, the Note aod nota securing Future Advances, if any, had no accelera~ion occurred; (b) Borrower cures all breacha of any other covenants or agreemeots of Borrower contained in this Mongage; (c) Borrower pays all reasonable expe~ses incurred by Lender in enforcing the covenants and ag~eements of Borrower contained in this Mortgage and in eo(orcing Lender's remedies as provided in paragraph 18 hereof, including. but not limited to, reasonable attomey's tees; and (d) Borrower takes such action as Lender may reaso~ably reyuirc to assure that the lien of this Moregage. Lenders intercst in the Prooerty and Borrower's obligation to pay the sums sccured by this Mortgage shall continue unimpaircd. Upon such paymeot and cure by Borrower, th~s Mortgage and the obligations secured hercby shall remain in full torce and effect as if no acceleration had occurred. 20. Assi~omeat oi Reot~ Appolntment of Receirer. As additional xcurity hereunder, Borrower hereby assigns to Lender the rcnts ot the Property, provided that Borrow~er shall, prior to acceleratio~ under paragraph 18 hercof or abandon- ment of the Propeny, have the right to collect and retain such rents as they M_come due and payable. Upon acceleration under paragraph 18 hereof or abando~ment of the Propeny, l.ender shall be entitled to have a rcceiver appointed by a court to enter upon. take possession of and manage the Property and to collect the rcnts of the Property. including thoae past due. All ren~s collected by the receiver shall be applied fint to payment of the costs ot management of the Property and collection of rents, including, but not limited to, receiver's fees, premiums on receiver's bonds and reasonable attorney's fees. and then to the sums secured by this Mortgage. 7l~e receiver shall be liable to account only for those ronts aetually receivGd. 21. Future Advaaca. Upon request by Borrowe~, I_ender, at Lender's option within twenty years from the date of this Mortgage. may make Future Advances to Borrower. Such Future Advances, with interest thercon, shall he secured by this Mortgage when evidenced by promissory notes stating that said notes are secured hereby. At no time shall the principal amount of the indebtedness secured by this Mortgage, not including sums advanced in accordance hercwith to prottet the security of this Mortgage. exceed the original amount o( the Note plus USS. ...... NOKFr. .. 22. Rdeaee. Upon payment of all sums secured by this Mortgage. Lender shall release this Mortgage without chuge to Borrower. Borrower shall pay all costs of recordation, if any. 23. Attoroey's Fees. As used in this Mortgage and in the Not~, "attorney's fees" shall inc!ude attorney's foes, if any, which may be awarded by an appellate court.
