FINAL JUDGMENT
The claim of the Plaintiff and the Counterclaim of the
Defendant/Counterclaimant were tried before the Court. On the
evidence presented, the Court finds that the Plaintiff, EDWARD
LAWRENCE, signed the purported trust agreement not as a witness,
but as the receiving tr~stee so that the trust agreement did
not comply with the requirements of Florida Statutes 689.01
requiring two (2) subscribing witnesses and therefor the trust
agreement was insufficient to convey the real property and
therefor, it is hereby
ORDERED AND ADJUDGED AS FOLLOWS:
1. The title of Defendant/Counterclaimant, PP.TRICIA J.
HUBBARD, to the following described real property in St. Lucie
County, Florida:
The North 60 feet of Lot 16, and the East 10 feet of the
North 60 feet of Lot 15, Block 1, MARAVILLA PARK SUBDIVI-
SION, as per plat thereof recorded in Plat eook 5, Page
13, of the Public Records of St. Lucie County, Florida.
is good title against the claim ar purported claim of the
Plaintiff/Counterdefendant, EDWARD J. LAWRENCE, Trustee, and ~f
all persons claiming by, through or under Plaintiff/Counter-~
defendant since the filing of the Notice of Lis Pendens and
those claims or purported claims are cancelled and the title to
the property is forever quieted in Defendant/Counterclaimant,
PATRICIA J. HUBBARD.
2. Costs will be taxed in favor of the Defendant/Counter-
claimant againt Plaintiff/Counterdefendant by further order of
this court.
