ORDER
This cause came on to be heard before this Court on the
23rd day of December, 1980, upon the Plaintiff's *4otion to
~ismiss the Counterclaim filed herein by the Defendant, and
upon the oral motion for the Defendant to amend. The Court
having considered said motions, the argument of counsel and
being otherwise duly advised in the uremises, it is thereupon,
ORDERED and ADJUDGED as follows:
1. As to Count I of the Defendant's Counterclaim, the
Court accents the Defendant's revresentation that relief is
being sought under Count I of the Counterclaim on the grounds
of scrivener's error and mistake of fact.
2. The Defendant's oral motion to amend Paragraph 20 of
Count II of the Counterclaim to allege an oral contract be, and
the same is hereby granted.
3. As to Count IV, the Defendant be, and the same is hereby
directed to nrovide to the Plaintiff, within thirt_y (30) days
from the date of this Order, a statement of particulars setting
forth the specific sums for which an accounting is being sought
by the Defendant in Count IV of his Counterclaim.
4. The Plaintiff's Motion to Dismi_ss be, and the same is
hereby denied, and the Plaintiff shall have fifteen (15) da_ys
