(1) This Court finds F.S. 440.11 (1) both
Constitut=onal and applicable to this cause.
(2) The Motion to Dismiss/Motion for Judgment on
the Pleadings filed on behalf of the Third Party Defendant,
WILLIAM H. AMES, in response to the Amended Third Party Complaint
for Contribution filed by the Third Party Plaintiff, FIARIDA
EAST COAST RAILWAY COMPANY, is hereby granted. This Court is
of the impression that Third Party Defendant is entitled to
a judgment in his favor as a matter of law based on the pleadings
fi led herein .
(3) In connection with the Amended Third Party
Complaint for Contribution, filed by Third Party Plaintiff
as against Third Party Defendant, judgment is hereby entered
in favor of William H. Ames and against Florida East Coast
Railway Company.
