WITNES'SETH: That Gcantor, for and in consideration of the sum of TEN (510.00) DOLLARS and other good and valuable consideration paid by Grantee, the receipt of which is hereby acknowledged, has granted, bargained, and sold to Grantee and Grantee's heirs and assigns forever the following described real property situated, lying and being in St. Lucie County, Florida, to wit: The Condaninium Parcel known as Apartincsent 12 ?-~ of Phase X~~I of HIGH POINT OF FORT PIERCE CONDOMINIUM SECTION II (the "Condominium") according to the Declara- tion of Condominium thereof, recorded in Official Records Book 3~4 at Pages 1396 through 1 S~8 of the Public Records of St. Lucie County, Florida as such Declaration may have been amended by any amendments thereto ' hereto filed in the Public Records of St. Lucie County, Florida including, but not limited to, any amendment to add the aforesaid Phase to the Condominium (if such Phase be other than Phase I thereof). Grantee, by acceptance hereof, and by agreement with GranLor hereby expressly assumes and agrees to be bound by and to comply with all of the covenants, terms, conditions and provisions set forth and contained in the aforedescribed Declaration of Condominium, including, but not li~nited to, the obllgation to make payment of assessments for the maintenance and operation of the Condominium which may be levied against the above described Apart- ment. Grantee expressly acknowledges the e~dstence ~of a"Settlement Stipula- tion and Agreement for and Grant of Easeaaents and Other Rights (the "Settle- ment Stipulation") and a Declaratton of Protective Covenants and Restrictions (the "Protective Covenants" ), as hereinafter set. forth . The Settlement Stipu- lation provides for this Condominium to be served by certain facilities of High Point of Fort Pierce Condominium Section 1 and the Protective Covenants provides for certain land use covenants upon the land area~ described therein (including, but not limited Lo, portions of the land areas included within this Condominiwn) and prnvides for certain drainage easements and other ease- ments and rights including, but not limited to, the "Roadway Easement", "Sewage System Rights" ,"Water System Rights" and "Future Development~ Property Drainage Easement", all as are more particularly described therein, all in addition to the other matters set forth in the Settlement Stipulation and Protective Covenants, which other matters include, but are not limited to, the obliqation to pay certain "Assessments" as are respectively set forth in the Settlement Stipulation and Protective Covenants .
