sells any portion of its land to any other person at which
time the maintenance costs would be divided in proportion
to the amount of land owned by all users. If said road is
dedicated to the County, or any other governmental institution,
Buyer's obligation shall be abated.
5. Seller shall provide any assistance necessary in
the obtaining by Buyer of any zoning, drainage or other land
use permits from any lbcal, State or Federal governmental
body .
6. Buyer shall provide to Seller lien waivers executed
by any engineers, surveyors, or planners that enter upon the
said property prior to the closing of this transaction. In
the event Buyer commences any construction on said property,
Buyer must before commencment comply with paragraph 2(c)

!; 7. Seller shall provide Buyer with a drainage easement

!; over and across Seller's property, said easement to be determined
by the parties working together with their engineers and Seller
further agrees to work with and cooperate with Buyer in the

;; formation of a drainage plan suitable for both parties, the

~~ intent of which is to prevent Buyer from being without access

~~ to drainage for his property.

; 8. At the time of closing, Seller shall at his expense,
;; furnish Buyer a policy of title insurance written by a title

:~ insuror acceptable to Buyer insuring the title to the property
'; to be free and clear of all defects.

'' 9. The property to be conveyed is to be conveyed by

;; Warranty Deed, free and clear of all liens, restrictions,

: encumbrances and easements, excepting for the above mentioned
Purchase Money Mortgage. Otherwise title to the property
shall be good and merchantable and such as will be insured
by any reputable title insurance company at the regular rates.
10. Buyer shall pay all Purchase Money Mortgage recording
