PETITION FOR DISCHARGE OF GUARDIAN
The undersigned, as guardian of the person and property of
FRANK J. I~dACKEY, incompetent, alleges:
1. The need for the continuation of this guardianship no longer
exists by reason of the fact that Frank J. Mackey died on December
1980. (A certified copy of the death certificate is attached hereto.)
2. Petitioner was appointed as guardian of the property and
person of Frank J. Mackey on November 12th, 1980, but no assets were
transferred to petitioner, as legal guardian because of the death of
the incompetent on December 2nd , 1980. Petitioner did not have
possession of any assets of the incompetent nor were any assets
transferred to Petitioner as a result of her appointment as guardian
of the property. Therefore, it is not necessary for petitioner to
file an accounting or final return for the guardianship.
3. Petitioner represents that there is no necessity for a notice
of hearing for final discharge because the Personal Representative of
the estate of decedent has waived notice.
WHEREFORE, petitioner requests that an order be entered
disch arging petitioner as guardian and releasing the surety, Reliance
Insurance Company, on Petitioner°s bond, from further liability.
