ROUTT, ~II, who currently resides at 612 Alleghany Avenue, Staunton, Virginia 24401. Fifty percent (50~) of my aforesaid estate to my niece, JANE E. RAMEY, who currently resides at 109 Capitol Drive, Martinsbuxg, West Virginia, In the event the aforesaid Jane E, Ramey does not survive me by a period of thirty (30) days, then I give, devise and bequeath her share of my aforesaid estate to her daughter, MRS. WILLIAM ~IAMMOND, who currently resides at 213 East Martin Street, Martinsbuzg, West Vi~ginia 25401. FOURTH: A. I nominate, constitute and appoint SCOTT M. KENNEY, as Personal Representative of my estate. In the event of the death, resignation, removal or failure to qualify or serve of my said Personal Representative, I nominate, constitute and appoint JACQUELINE L. RUSSAKIS, to serve as alternate Personal Representative. I direct that no bond or other security shall be required of my Personal Representative or said alternate,'in any ~urisdiction, to secure the faithful performance of the duties herein. B. In the investment, administration and distribution of my Estate, my Personal Representative shall be governed by the provisions of Sections 733, 737 and 738 of the Florida Statutes, 1975, that are not otherwise in conflict with this instrument and shall have all additional powers and protection granted by Statute that are not in conflict with this instrument. In addition, and not in limitation of any com~on law or statutory authority, and without application to any Court, my Personal Representative shall also have the powers and responsibilities described below to be exercised in his absolute discretion, as lang as such powers and responsibilities are not in conflict with any other specific terms of this instrument: 1) To make distributions to custodians for minors under the Florida Gifts to Minors Act. 2) To use income to pay administration expenses or estate taxes for a decedent's estate. ~ 3) To treat income in respect of a decedent as income instead of as principal. rR346 ~01 Page 2 of 4 a~~K PdGE
