WITNESSETN: ~ ---------..._~ That Grantor, for and in consideration of the sum of TF.N (=10.00) DOLLARS and other good and valuable consideration paid by Grantee, the receipt of which is hereby acknowledged, has granted, bargained, and sold to Grantee and Grantee's heirs and assigns forever, the following described real property situated, lying and being in St. Lucie County, Florida, to-wit: The Condominium Parcel known as Apartment 830E of Phase II of HIGH POINT OF FORT PIERCE CONDOMINIUM SECTION III (the "Condominium") according to the Declar- ation of Condomfnium thereof ("Declaration"), recorded in Official Records Book 3~_ at Pages 2403 through2542 of the Public Records ~ St. Lucie County, Florida as tl~e Declaration may have been amended by any amendments recorded in the Public Records of St. Lucie County, Florida including, but not limited to; any amendment to add the aforesaid Phase to the Condominium (if such Phase be other ihan Phase I thereof). Grantee, by acceptance hereof, and by agreement with Grantor hereby expressly assumes and agrees to be bound by and to cnmply with all of the covenants, terms, conditions and provisions set forth and contained in the aforedescribed Declaration of Condominium, including, but not Iimited to, the obligation to make payment of assessments for the maintenance and operation of the Condominium which may be levied against the above-described Apart- ment. Grantee expressly acknowledg~s the exisience of a Settlement Stipula- tion and Agreement for and Grant of Easements and Other Rights• (the "Settle- ment Stipulation") and a Declaration of Protective Covenants and Restrictions {the "Protective Covenants") , as well as the "Designation Notice" modifying the Settlement Stipulation and Protective Covenants, all as hereinafter set forth. The Settlement Stipulation provides for this Condominium to be served by certain facilities of High Point of Fort Pierce Condominium Section 1 and the Protective Covenants provides for certain land use covenants upon the land areas described therein (including, but not limited to, portions of the land areas included within this Condominium) and pravides for certain drainage P.asements and other easements and rights including, but not limited to, the "Roadway Easement" ,"Sewage System Rights" ,"Water System Rights" and "Future Development Property Drainage Easement" , all as are more particular- ly described therein , all in addition to the other matters set forth in the Setdement Stipulation and Protective Covenants, which other matters include, but - are not Iimited to, the obligauon to pay certain "Assessments" as are respectively set forth in the Settlemeni Stipulation and Protective Covenants .
