HomeMy WebLinkAbout0740~ ,~,ti, , . . ~=+ 512831 f $~~~~~~ ~ 7 PAItT1AL RF.LEASS OF MORTGAGC L[F.N ~ ~Vi~EREAS, HUTCHINSUN ISLAND I.IM!'I'ED, 1NC., a Uelawace cocporation authorized to transact business in the State of Florida, hereinafter called "Mortgagoc," by the following described ~ocuments grunted and conveyed unto THE FII~ST NATI013AL BANK OF C}iICAGO, a national banking associ~tion, hereinafter called "lllortgagee" and its assigns, thc pcemises and pcope~ty therein partieularly described to secure the payment of the sui~i of money hereinafter mentioned with interest thereon: ~ Mortgage given by HUTCHINSON tSLAND WMITED, INC., as Mortgagor, in favor of THE FIRST NATIONAL BANK OF CHICAGO, as Mortgagee, dated June 2, 1980, and filed in Official Record Book 332, at Page 1703, in the Public Records of St. Lucie County, Florida, in the original amount of Twelve Million Seven Hundred Thousand Dollars (t12,700,Q00.00), together with an Assigiiment of Leases~ Rents and Profits recorded in Official Record Book 332, at Page 1728, and Assignment of Sales Contracts recorded in Offieial Record Book 332, at Page 1735, and UCC-1 Financing Statement reeorded in Official Record Book 332, at Page 1721, all of said documents filed in the Public Records of St. Lucie County; Florida, and all of said doeuments recorded on June S, 1980; and in addition, a UCC-1 Financing Statement filed with the Secretary of State, State of Florida, on June 16, 1980, under File No. 1207244, between said parti~s; and WHEREAS, the said IVlortgege has requested the said Mortgagee to release the premises and other property hereinafter described, being a part of said lilortgage, and encumbered premises, from the liens and operation of said Mortgage and othec liens; NOtV, THEREFORr, KNO~V YE, that the said Mortgagee, in consideration of the premises and the sum of Ten Dollars (~10.00) and other good rind valuable considerations to it in hand paid by or on behalf of the said mortgagor at the time of the execution hereof. the receipt whereof is hereby acknowledged, does remise, release, quit-claim, exonerate, and discharge from the lien and operation of said 1+lortgage and other liens referred to above unto th~ said :~lortgaf;or, its successors and assigns that certain ~ortion of the premises cor:veyed by stiid 1lortgage, and other liens referred to above more partieularly described as follows: Condominium Unit No. 7332 CATA~IA~tAN II, PHASE B, a Condominium, according to the Declaration of Condominium recorded July 15, 1980, in Offieial Records Book 334, at Page 2451, of the Publie Records of St. Lucie County, Florida. TO HAVE AND TO HOLD the same, with the appurtenances, unto the said Mortgagor, its successors and assigns forever, freed, exonerated and discharged of and from the lien of said Mortgage and every part thereof; provided always, nevertheless that nothing herein contained shall in anywise impaic, elter or diminish the effect, lien oc encumbrence of the aforesaid Mortgege and other liens referred to above on the remaining property of said mortgaged premises, not hereby released therefrom, or any of the rights and remedies of the holder thereof.
