~VHEREAS, RUTCHINSON ISLAND LIMITSD, INC., a Delaware
corporation authorized to transact business tn the State of Florida, heceinafter
called "Mortgagoc,' by the following described documents granted and conveyed
unto THE F[RST NATIONAL HANK OF CHICAGO, a national banking assoeiation,
hereinafter called "hfortgagee" and its assigr-s, the pcemises and property therein
particularly described to secure. the payment of the sum of money hereinafter
mentioned with interest thereon:
- Mortgage given by HUTCHINSON ISLAND I.IMITED, INC., ~ as
Mortgagoc, in favor of THE FIRST NATIONAL BANK OF CHiCAGO, as Mortgagee,
dated June 2, 1980, and filed in Official Record Book `s32, at Page I?03, in the
Public Records of St. Lucie County, Florida, in the original amount of Twelve
Million Seven Hundred 'IT~ousand Dollars (~12,"00,000.00), together with an
Assignment of Leases, Rents and Profits recorded in Official Record Book 332, at
Page 1728, and Assignment of Sales Contracts cecorded in Offieial Record Book
332, at Page 1735, and UCC-1 Financing Statement recorded in Officiul Record
Book 332, at Psge 1721, all of said documents filed in the P~lic Records of St.
Lueie County, Florida, and all of said documents recorded on June S, 1980; and in
addition; a UCC-1 Financing Statement filed with the Secretary of State, State of
Florida, on June 16, 2980, under File No. 1207244. between said parties; and
WHEREAS, the said ~lortgage has requested the said ~IortgegeE to
release the premises and other property hereinafter described, being a part of said
~lortgage, and encumbered premises, from the liens and operation of said 1~'Iortgege
and other liens;
NOW, TfiEREFORE, KNOtiV YE, that the said tiiortgagee, in
consideration of the premises and the sum of Ten Dollars (s10.00) and other good
and valuable considerations to it in hand paid by or on behalf of the said mortgagor
at the time of the executian hereof~ the receipt whereof is hereby acknowledged,
daes remise, release, quit-claim, exonerate, and discharge from the lien and
operation of said -1lortgage and other liens referred to above unto the said
\'[ortgagor, its successors and assigns that certain portion of the p~emises conveyed
by said ~lortgage, and other lierLS referred to above more particularly described as
follows:
Condominium Unit No. 7532, CATA~IARAN II,
PHASE B, a Condominium, according to the
Declaration of Condominiusn recorded July 15, 1980,
in Official Records Book 334, at_ Page 2451, of the
Public ftecords of St. Lucie County, Florida. ~
TO HAVE AND TO HOLD the same, with the appurtenances, unto the
said -1~lortgagor, its suceessors und assigns forever, freed, exonerated and
discharged of and from the lien of said ti'Iortgage and every part thereof; ~provided
always, nevertheless that nothing herein contained shall in anywise impaic, alter or
diminish the effect, lien or encumbrence of the aforesaid Mortgage and other liens
referred to above on the remaining property of said mortgeged premises, not
hereby released therefrom, or any of the rights and remedies of the holder thereof.
IN WITNESS WHERFOF, Lhe said Mortgagee has hereunto set its hand
