HomeMy WebLinkAbout1044 r ~~ \ r_ ~~~ a -~:~ -~ ,~ ~~ r~ `~ ~, _~ ~* r ~~; .~,. ~r ~~ i ~ L ~ :; ~.~i RECEIPT, ACKNOWLEDCMENT~ ASSUMPTION AND ACCEPTANCE OF PURCFiASER Purchaser, by acceptance and execution of this Receipt, acknowledges that this purchase of a condomintuco unit at OCEAN VILLAGE OF HUTCHINSON ISLAND is sub~ect ir. every respect to~the Declaration of Condominiun as to the condominium in which his unit is located and Exhibits attached thereto, including but not lim- ited to (Whether the same are attached to the Declaration of Condominium or re- ferred to therein), the By-Lar+s of the Association, Articles of Incorporation, the Rules and Regulations, copy of pro~ected operating budget, copy of sales brochure and floor plan of apartment purchased by purehaser, and all A~nendments to the aforesaid Declaration and Exhibits and the Articles of Incorporation, By-Laws and Declaration of Covenants and Restrictions of the Property OWners Association; and Purchaser further acknaaledges receipt of and reading and examination of said Declaration, its Exhibits, budget, sales brochure and floor plan, and acknowledges that each and every provision of the foregoing is essen- ti?1~ to the successful operation and management of the Condominium property and is in the best interests and for the benefit of all the oWners therein. Purchaser and all owners of parcels in the aforedescribed Condominiumn coven- ant and agree to abide by each and every provision of said Declaration and Exhibits attached thereto. Purchaser hereby ratifies and confirms and approves all of the terms and provisions of said Declaration of Condomini~ and Exhibits attached thereto, and agrees that the assessment under the Property Owner's Association documents referred to above and the provisions thereof are reason- ahle, fair and equitable, and said Purchaser acknoWledges and confirms that the Declaration of Covenants and Restrictions of the Property OWner's Association has encumbered and'impressed a lien upon the Condominium parcel being conveyed to Purchaser, as security for-his obligations under said Declaration of Coven- ants and Restrict~ons, and said Purchaser assar:~s the obligations as to the ?roperty OWner's Association as to his condomi~ium parcel. Purchaser confirms that all warranties, representations, and inducements, if any, are as contained in the aforesaid Declaration of Condomini~sn and Exhibits attached thereto, and the common expenses and the sums due under the Property Owner's Association and other charges are estimated only. No Warranty or guaranty i.s made or intended nor may one be relied upon except Where the same is specifically Warranted or guaranteed in said Declaration of Condominiun and Exhibits attached thereto.
