8. Borrower shall, upon request of Bank, furnish it a com-
plete list of all Contracts, Licenses and Sales Agreements. Fur-
ther, if requested, Borrower shall deliver to Bank executed or
certified copies of all Contracts, Licenses, Sales Aqreements, and
other written agreements, correspondence and memoranda between
Borrower (and its predecessors in title) and Contractors, Govern-
mental Authorities and Purchasers, setting forth the contractual
and other arranqements between them. To the extent~that Borr_ower
d~es not have executed or certified copies of the foregoing in its
possession, Borrower shall deliver copies of those of the fore-
going which are in its possession, with a certificati~n that t~
the best of Borrower's knowledge and belief, they are true and
correct copies.
9. Nothing herein contained shall be construed as makinq
Bank a mortgagee in possession, or as constituting a waiver or
suspension by Bank of its right to enforce payment of the debts
under the terms of the Note, Mortgage, Loan Agreement, or other~
Loan Documents. eank is not the agent, partner, or joint venturer
of E3orrower or of any of the Contractors, Governmental Authorities
or Purchasers.
10. This Assiqnment may be enforced from time to time by Bank
at its discretion, with or without order of any court and wiCh or
without appointment of a receiver, as Bank shall determine. Bank
may also at any time cease to enforce this Assignment. Any fail-
ure on the part of gank promptly to exercise any o~tion hereby,
