11.2 UtilitX Easements. Easen~ents are hereby gra~ted
and reserved for the Developer, Declarant, unit owners, the ~
Pro~erty Owners Association and the Association through the
condominium property as may be required for utility service in
order to serve the Condominium and the balance of Tarpon eay Yacht
Club adequately; provided, hawever, such easements through a unit
shall be only according to the plans and specifications for the
building, or as the building is constructed, unless approved in
writing by the unit owner.
11.3 Ingress and Egress. An easement is hereby
granted for pedestrian traffic over, through and across such
portions of the common elements as may from time to time be
iritended and designated for such uses and purposes, for the use
and benefit of the unit owners, their families and invitees, in
obtaining ingress and egress from the units to the Common
Property.
11.4 Construction of Improvements on Balance of
Tarpon BaX Yacht Club. The unit owners recognize that Developer
and others may have the balance of Tarpon Bay Yacht Club under
development for an extended time. Incident to that development,
the unit owners acknowledge that tl~e quiet enjoyment of their
u~its, the Condominium Property and the Common Property may be
interfered with to some extent by construction operations on the
balance of Tarpon Bay Yacht Club. From time to time Developer and
others m~ay present to the public certain renderings, plans and
models showing possible future development of Tarpon Bay Yacht
Club. Developer does not warrant in any way these renderings,
plans or models or actually how the future improvements in Tarpon
Bay Yacht Club will be developed. Unit owners accept that any
such rend'erings, plans or models are primari~y schematic 'and in no
way represent a final development plan of Tarpon Bay Yacht Club.
As a material condition for ownership of a unit, each unit-
owner releases Developer from any claim that he might have against
Developer for the future development of Tarpon Bay_Yacht Club.
Each ~nit owner-acknowledges and agrees that Developer and others
will have_sole right of design, construction, development, and
improvement of the balance of Tarpon Bay Yacht Club, exclusive of
this Condominium. The unit owners, as a material condition to
their ownership of a unit, waive all claims against Developer and
others for interference with their quiet enjoyment accasioned
through development of the balance of Tarpo:~ Bay Yacht Club.
12. S10RAGE ROOMS. Portions of the condominium property
contain storage rooms, the location of which are shown on Exhibit
"e" attached to this Declaration. The storage rooms shall be
conanon elements, but Developer reserves the right to assign and
regulate all storage rooms until Developer has sold all units in
the Condominium or until Developer relin~uishes control of the
Association, whichever shall occur first. Developer shall assign
one (1) storage room to each unit.
13. MEMBERSHIP IN ASSOCII~TION AND VOTING RIGHTS.
13.1 Membershi~. Every owner of a unit, whether he
has acquired title by purchase from Declarant, Declarant's
grantees, successors or assigns, or by gift, conveyance or
operation~ of law, is bound to and hereby agrees that he shall
accept membership in the Association and does hereby agree to be
bound by this Declaration, the ey-Laws of the Association and the
rules and regulations enacted pursuant thereto, and the provisions
