I, MABLE L. CHARLES, a resident of St. Lucie County,
Florida, being of sound and disposing mind and memory, do make,
publish and declare this to be my Last Will and Testament, hereby
.
revoking all former Wills by me~at any time made, and intending
hereby to devise and bequeath all of the property, both real and
personal, of which I may die seized and possessed, or to which I
may be entitled at the time of my death, wherever the same may be
situated, as follows, to-wit:
FIRST: I direct my personal representative hereinafter
named to pay all of my just debts and funeral expenses as soon
after my decease as is practicable.
SECOND: I give, devise and bequeath unto RUTH B. COKER
the sum of Ten Thousand ($1D,000.00) Dollars, to have and to hold
unto herself absolutely and forever.
THIRD: I give, devise and bequeath unto CARMEN HARRIS
the sum of Five Thousand ($5,000.00) Dollars, to have and to hold
unto herself absolutely and forever.
FOURTH: I give, devise and bequeath unto MYRTLE ANN CHARLES,
as Trustee for DON THOMAS and JOHN THOMAS the sum of Ten Thousand
($10,000.00) Dollars, in trust, and direct that she deposit same in
a federal savings and loan institution and that the corpus and pro-
ceeds of the trust shall be used for the educational expenses of
the beneficiaries. Educational expenses shall be defined as tuition,
room, board and books. The Trustee shall pay amounts as she deems
appropriate, and the amounts do not necessarily have to be equal.
Neither beneficiary shaTl have the right to compel payments, and
all payments shall be made in the sole discretion of the Trustee.
In the event there are funds remaining in the trust not used for the
education of either or both beneficiaries, then the Trustee shall,
upon the beneficiaries attaining the age of twenty-five (25) years,
distribute the remainder of the trust as the Trustee deems appropriate
.
