MODIFICATION, RELEASE, AND ASSUMPTION ACREEMENT
The parties to this agreement are F. JEAN RODGERS,
~p.
hereinafter called "Lender" and DORIS J. HARVEY, hereinafter called
"New Obligor".
w'HFREAS, ANTHONY A. ABBATIELLO and ROSE ABBATIELLO, his
wife, executed a Promissory Note on February•1, 1978 evidencing a
principal indebtedness of $28,000.00, secured by a Mortqage upon
real property k~own as: Lot 15, Block 8, River Park, Unit 1, a
subdivision acco.rding to'the Plat thereof as recorded in Plat Book
10, Page 69 of the Public Records of St. Lucie County, Florida, and
WHEREAS, the said obligors conveyed the aforesaid
~roperty to JOSEPH MOLA, JR., by Deed dated September 17, 1979 and
filed for record on September 19, 1979 in O. R. Book 316, Paqe 2807
~f the Public Records of St. Lucie County, F'lorida, said conveyance
~eing subject to the aforesaid Mortgage and
WHEREAS, the Lender entered into an agreement with the
~aid JOSEPH MOLA,~JR., modifyinq the terms and conditions of the
~foresaid Mortgage, such modification being dated September 17,
1979 and filed for record on December 12, 1979 in O. R. Book 322,
~age-23 of the Public Records of St. Lucie County, Florida and
WHEREAS, the_said JOSEPH MOLA, JR., is about to convey
:he aforesaid property to the New Obligor herein subject to the
~foresaid Mortgage of the Lender
NOW THEREFORE, in consideration of the mutual promises
~ind covenants contained herein the parties agree as ~ollows:
1. Lender does hereby consent and agree to the
~onveyance of the aforesaid-property to the New Obligor subject to
the Mortgaqe originally granted and conveyed to the Lender.
2. The New Obligor does hereby expressly assume and
gree to pay the indebtedness represented by the aforementioned
~romis o ~
s ry Note in the original principal sum of S28,OOO.QO without
efense or offset and aqrees to be liable therefore as fully and to
he same extent as if the original maker thereon. In addition, the
few Obligor agrees to personally perform and to fully abide by all
•f the terms and conditions set forth in the aforesaid Note and
~lortgage.
