LAST WILL AND ~ESTAMENT OF PAUL G. ENNS - Page Four
CLAUSE VI: Al1 the residue of my estate, wherever
situated, including lapsed devises, but expressly excluding
any property over which I may have power of appointment at
my death, I devise to my Trustee hereinafter named. The
trust shall be designed "TRUST B" and shall be held and dis-
posed of as follows:
A. If my wife survives me, then commencing with
my death the Trustee may pay as much of the income as
the Trustee determines to be necessary from TRUST B,
at least quarterly, to or for her benefit during her
lifetime. Any income not so used shall be accumu-
lated and reinvested. The Trustee may also pay to or•
for my wife•s benefit such sums from principal as the
Trustee deems necessary or advisable•from time to
time for her health and maintenance in reasonable
comfort, considering the income of my wife from all
sources known to the Trustee, but shall make no
invasion of TRUST B for my wife so long as any
readily marketable assets remain in TRUST A.
B. Upon the death of my wife (or upon my death if
my wife does not survive me), my entire trust estate
or probate estate, as the case may be, shall be
distributed outright to my stepson, HARKLESS G.
ENNS, provided that if he shall not survive me, then
to his wife, RANDY ANN ENNS.
CLAUSE VII: In order to carry out the purposes of
the trusts created under this Will, the Trustee shall have
all of the rights, powers, duties and responsibilities
granted to Trustees under Chapters 737.402 and 738, Florida
Statutes, as those statutes are presently constituted and as
they may be amended from time to time.
CLAUSE VIII: I name and appoint my stepson, HARKLESS
G. ENNS, as personal representative of this Will, to serve
without bond and as Trustee of the trusts created hereunder,
to serve without bond. In the event he shall die, resign, or
be unable for any reason to act or to continue acting as
such, then I name and appoint CHESTER B. GRIFFIN, F'ort
Pierce, Florida, as such personal representative and as
trustee, to serve without bond. .
My personal representative shall have all of the
rights, powers, duties and responsibilities granted to per-
sonal representatives and to trustees under Chapters.733.612,
