FINAL JUDGMENT IN FORECLOSURE
This case was heard before the Court and the Court finds
from the evidence that the Defendants were in default of the
mortgage on February 25, 1980 when this action was filed, for
failure to make a payment of $7,811.28 on December 30, 1979 as
required. The Court further finds that a compromise offer was
made by the attorney for the Plaintiff on March 26, 1980, which
conditions were accepted by the Defendants on March 28, 1980 as
evidenced by their signatures while simultaneously making a
$10,000.00 payment as provided in the letter agreement and this
acceptance of the terms in the letter agreement constituted a
compromise agreement between the parties. The Court further
finds that the Defendants failed to make the $99,773.95 payment
as provided by May 15, 1980 and it is therefore
ORDERED AND ADJUDGED that:
1. Plaintiff, ANNA KRAMER, is due and owing $99,773.95 as
of May 15, 1980, plus accrued interest at eight~percent (8$)
per annum as provided in the original note, as the Court finds
there is a substantial question that the fifteen percent (15$)
interest as provided in the letter agreement is limited to May
15, 1980 or should continue to accrue and that because the
letter agreement was prepared by the attorney for the Plain-
tiff, the Court holds that the agreement did not specifically
provide for fifteen percent (15$) interest to accrue after May
15, 1980, and therefore the interest will revert back to eight
