PAftTIAL RELEASB OF MORTGAGE LIEN
WHEftEAS, HUTCHINSON ISLAND LIMITED, INC., a Delaware
corporation authorized to transact business in the State of Florida, hereinafter
called "Mortgagoc," by the following desc~ibed documents granted and conveyed
unto THE~FIRST NATIONAL BANK OF CHICAGO, a national banking-association,
hereinafter called "ll~ortgagce" and its assigns, the premises and property therein
particularly described to secure the payment of the sum of money hereinafter
mentioned with interest theceon:
Mortgege given by HUTCHINSON 1SLAND LIMITED, INC., as
Moetgagor, in favor of THE FIRST NATIONAL BANK 4F CHICAGO, as Moctgagee,
dated June 2, 1980, and filed in Offictal Record Book 332, at Page 1703, in the
Public Records of 5t. Lucie County, Florida, in the original amount of Twelve
Million 3even Hundred Thousand Dollars (S 12,700,000.00), together with an
Assignment of Leases, Rents and Profits recorded in Official Record Book 332, at
Page 1728, and Assignment of Sales Contracts cecocded in :Official Record I3ook
332, at Page 1735, and UCC-1 Financing Statement recorded in Official Record
Book 332, at Pege 1721, all of said documents filed in the Public I'.ecords of St.
Lucie County, Florida, and all of said documents recorded on June 5, 1980; and in
addition, a UCC-1 Financing Statement filed with the Secretary of State, State of
Florida, on June 16, 1980, under File Vo. 12~17244, between said parties; and
WHEKEAS, the said Mortgage has requested the s~id ~+Iortgegee to
release the pre,: ises and other property hereinafter described, being a part of said
Mortgage, and encumbered premises, from the liens and operation of said blortgage
and other liens; ~
NOW, THEREFOftE, KNOW YE, that the said hiortgagee, in
consideration of the premises and the sum of Te~ Dollars (~10.00) and other good
and valuable eonsiderations to it in hand paid by or on behalf of the said mortgagor
at the time of the execution hereof, the receipt whereof is hereby acknowledged,
does remise, release, quit-claim, exonerate, and discharge from the lien and
operation of said Mortgage and other liens referced to above unto the said
Mortgagor, its successors and assigns that certain ~ortion of the premises conveyed
by said l~iortgage, and other liens referred to above more particularly described as
follows:
Condominium Unit ho. 75~5, CATAA4ARAN II,
PHASE B, a Condominium, accoMing to the
Deelaration of Condominium recorded July 15, 1980,
in Official Records Book 334, at Page 2451, of the
Public Records of St. Lucie County, Florida.
TO HAVE AND TO HOLD the sarne, wit~i the appurtenances, unto the
said ;~iortgagor, its successors and assigns forever, freed, exonerated and
discharged of and from the lien of said 1+iortgage and every part thereof; provided
always, nevertheless that nothing herein contnined shall in any:vise impair, alter or
diminish the ~ffect, lien or encumbrance of the ~foresaid Mortgage and other liens
referred to above on the remainirig property of said mortgaged premises, not
hereby released therefrom, or any of the rights and remedies of the holder thereof.
IN WITNESS WHEREOF, the ~id 1~lortgagee hes hereunto set- its hand
and seal this 20 day of August, 1980.
