settlement of all Plaintiffs' claims against TRUDY
ELSIGAN, individually, TRUDY ELSIGAN as Personal S~~JO
Representative of the Estate of EDWARD H. PIEPEREIT, and
AMERICAN MOTORISTS INSURANCE COMPANY, arising out of the
inuuries sustained by the minor,~LILLIAN GUTIERREZ in
the accident of August 8, 1978.
3. ARMANDO GUTIERREZ, as natural father and next
friend of LILLIAN GUTIERRE Z, a minor, ARMANDO GUTIERREZ ,
individually, and DOLORES GUTIERREZ, individually,
are hereby authorized to execute a Release in favor
of Defendants, TRUDY ELSIGAN, individually, TRUDY
ELSIGAN as the personal representative of the Estate of
EDWARD H. PIEPEREIT, and AMERICAN MOTORISTS INSURANCE
COMPANY of all claims of Plaintiffs arising out of the
injuries sustained by the minor, LILLZAN GUTIERREZ~ lIl
the accident of August 8, 1978.
4. ~rihen the funds and Releases have .been exchanged
between Petitioners, the parties hereto shall execute and
file a Joint Stipulation of Dismissal on behalf of all
parties to this action.
5. Neither the entry of this Order nor compliance
with the provisions of this Order shall prejudice or
otherwise affect Plaintiffs' right to continue the full
pros~cution of their pending underinsured motorists claim
against LIBERTY MUTUAL INSURANCE COMPANY for full
compensation of any damages Plaintiffs are entitled to
receive. ~
6. The parties shall follow the disbursement
procedure set forth in the foregoing Petition.
