Southport Associates, a partnership~ owners and ~ developers of Southport ShQpping Center. have applied for approval of the site plan for expansion of Southport Shoppinp Center located on Morningside Boulevard in the-City of Port St. Lucie. Florida, ~ and WHEREAS, Southport Associates, during the course of the site plan approval hearin~s~ agreed that a condition of the site plan if approved, would be that the applicant, or its successors in interests, would pay a proportional share of the costs of road improvements on Morningside Boulevard if the traffic count exceeds~ within a period of three (3) years from the date of completion of D~ ~ the nroject, ten thousand (10,000) daily trips per 24-hour period as measured on Morningside Boulevard imr.iediately in front of Southport Shopping Center, said proportional share being based upon a front- foot assessment of property contained in Southport Shopping Center~_ and WNEREAS,.Southport Associates has, by Affidavit, confirmed the obligation to pay its proportional share for improvements on Morningside Boulevard should they become necessary, as outlined above, a copy of said Affidavit beinp attached hereto and incorporated herein as Exhibit A, and WHEREAS, the City Council of the City of Port St. Lucie has voted approval of said site plan, NOw', THEREFORE, BE IT RF.SOLVED BY TNE CITY COUNCIL OF THE CITY OF PORT ST. LUCIE THAT: , 1. That the site plan submitted by Southport Associates for the further developmer~t of Southoort Shopping Center located on Morningside Boulevard in the City of Port St. Lucie, Florida, having as a condition of that site plan an obli~ation of Southport Associates, or their successors in interest, to pay a proportional share, based on t he front-foot assessment of the property contained in Southport Shopping Center, costs of any required road improvements on t~orningside ~~"~346 P~~9 . __ _ - ~,.~~~~~ ..:> :_: ~-.~-:.::~ -.
