~ ADD~NDUM
ADDETIDUM to Contract # K-C94-12 , dated November S, 1980 . , between
TROPICANA PRODUCTS, INC., and S, N. KNIGNT & SONS, INC. •
Where this ADDErIDUM may be inconsistent with the printed portion of the
contract, the terms of the ADDENDUM shall prevail.
1. Notwithstanding the provisions of the contract, Tropicana Products,
Inc.'s participation price paid to Seller will be as camputed in
the contract, but will not be less than:
A. Seventy-five ($.75) cents per pound solids in the 1980-1981
season, upon delivery of that fruit to 1Yopicana's plant,
less applicable taxes and any other authorized deductions,
or
B. eighty (80X) percent of Tropicana Products, Inc.'s Daily
Cash Market Price, if greater than Paragraph A above, less
applicable taxes and any other authorized deductions, upon
delivery of that~fruit to Tropicana's plaat.
2. It is also understood that the prices set fprth above are guaranteed
prices for the year indicated. The actual price will be the
guaranteed price, PLUS all the rise determined by the formula
provided in the contract if it exceeds the guaranteed price provided
for herein.
3. It is agreed between Tropicana Products, Inc., the Buyer; and
S. N. KNIGHT ~ SONS, INC. , the Grower, that Specialty Fruit
produced by the Grawer fram his grove, and not used in other areas
of utilization wfll be received from the Grower, and the payoff
will be based on the early and midseason participation payoff less:
