EASEMENT MODIFICATION
WE, TARPON BAY VILLAS HONEOWNERS ASSOCIATION, INC., and
1'
ANDREW A, HENRY and AL6ERTA D. HENRY, his wife, grantees in those
certain Easements dated May 9, 1980, and recorded May 14, 1980, in
Official Records Book 331, pages 1002.through 1004 and 1016 and 1017,
in the Public Records of St. Lucie County, Florida, in consideration of
One Dollar (E1.00), receipt of which is acknowledged, do hereby agree
that the said Easements shall be and they are hereby modified to allow
common use for drainage structures and for utility purposes by any
utility in compliance with the ordinances and regulations of the City
of Port St. Lucie, Florida, including the ~right to construct and main-
tain over and under the underlying real property sUch lines, conduits,
cables, wires, pipes and culverts as may be necessary for such purposes.
PROVIDED, however, that the rights of the undersigned grantors of
this Easement Modification set forth in the Easements referred to herein
shall at all times be paramount and shall in no way be impaired or
interfered with by any use by virtue of this Modification.- Use of
the above set forth Easements shall at no time be blocked, and any
party installing or servicing any utility over or under these Easements,
shall be responsible to restore the Easement surface to a condition
equal to or better than that existing at the time said surface is dis-
turbed for any such purpose. Such surface restoration shall be com-
pleted within ten (10) days of the completion of any such utili~ty work.
