HomeMy WebLinkAbout2965prior to e~try of a judgment e~torcing this Mortgage if: (a) Borrowcr pays Lender all sums which would bo the~ due under this Mortgage, the Note and ~ota securing Futu~e Advances, it any, had no acceleration occurred: lb) Borrower cures all breaches of any other coveoants or agreements of Borrowe~ cantained in this Mattgage; (c) Borrower pays all reasonable expenses incurred by Lender in entorcing the covenants and ag~eements ot Borrawer contained in this Mortgage and in e~forcing I.ender's remedies as provided in pa~agraph 18 hereof, including, but ~ot limited to, reasonable attomey's fees; and (d) Borrower takes such action as Lender may reasonably rcyuire to auure that the lien of this Mortgage. Lender's interest io the Property and Borrower's obligation to pay the sums securcd by this Mortgage shall continue unimpaired. Upon such payment and curc by Borrower. this Mongage and the obligations secured hereby shall romain in full force and eBect as if no acceleration had accurred. 20. Assigameat ot Rent~ Appointmeat of Receive~. As adJitiunal securi~y hereunder. Borrowe~ hereby assigns to [_ender the rents of the Property, pro~•ided that Borrower shall, prior to acceleration undet paragraph 18 hereof or abandon- ment of tho Property, have the right to collect and retain such rents as they become due and payable. Upon acceleration under parag~aph 18 hereof or abandonment of the Property, l.ender shall be entitled to have a receiver appointed by a court to enter upon, take possession of and manage the Property and to collect the rents of the Property, including those past due. All rents collected by the receiver shall be applial 6rst to payment of the costs of management of the Property and collection of rents, including, but not limited to, receiver's fees, premiums on rective~'s bonds and reasonable attorney's fces. and then to the sums secured hy this Mongage. The receiver shall be liable to account o~ly (or those rents actually received. 21. Future Advaaccs. Upon reyuest by Borrower, Lender, at Lender's option within twenty years from the date of this Mortgage. may make Future Advances to Borrower. Such Future Advances, with intercst thereon, shall be secured by this Mortgage when evidenced by promissory notes stating that said notes are secured hereby. At no time shall the principal amount of the indebtedness secured by this Mortgage, not i~cluding sums advanced in accordance herewith to protect the security of this Mortgage. exceed the original amount of the Note plus USS. . .
