regular meeting of inembers called for such purpose, of which thirty (30) days .
written notice was sent to each member, a two-thirds (2/3) vote of each Class of
members was obtained, either in person or by proxy, agreeing to such dedication or
transfer.
Section S. Parkin~ Ri~hts. The Association may designate and maintain
upon the Co~on Properties certain parking spaces for the exclusive use of the
Members, their families and guests. The use of any such parking space by any
other person may be en~oined by the Association or the Members entitled thereto.
No parking shall be permitted in other than designated parking areas.
Section 6. Utility Easements. There is reserved unto~the Developer until
the date on which control of the Association is turned over to the Class "A"
Members as provided in Article III, Section 2 hereof, the right to grant ease-
ments for the installation and maintenance of temporary roads and public utilities
on the Common Properties in addition to those already reserved. No such grant
shall require the removal or relocation of any improvements existing on the
Common Properties on the date of the grant.
Section 7. Party Walls. Each wall which is_built as a part of the original
construction of the c2uster homes upon the Properties and plaeed on the dividing
line between portions of the Lots shall constitute a party wall, and, to the
extent not inconsistent vith the provisions of this Article, the general rules of
law regarding party walls and liability for property damage due to negligence or
willful acts or omissions shall apply thereto.
(a) Sharing of Repair and Maintenance. The cost of reasonable repair
and maintenance of a party wall shall be shared by the Owners who make
use of the wall in proportion to such use.
(b) Destruction by Fire or Other Casualty. If a party wall is
destroyed or damaged by fire or other casualty, any Owner who has used the wall
may restore it, and if the other Owners thereafter make use of the wall, they
shall contribute to the cost of restoration thereof in proportion to such use
without prejudice, however, to the right of any such Owners to call for a larger
contribution from the others under any rule of law regarding liability for
negligent or willful acts or omissions.
(c) Weatherproofin~ Notwithstanding any other provision of this
Article, an Owner who by his negligent or willful act causes the party wall to
