T4 MORTGAGE DEED FROM JAMES J~. PARDIECK, as Trustee
TO AQUA RABELLA ASSOCIATES, a Florida General Partnership, dated
January 6, 1981.
RELEASE CLAUSE
A) ~Upon request of the mortgagor and provided that the mortgage is
then current and otherwise in good standing, the mortgagee shall
grant partial releases for lands as measured along the westerly
Right-of-Way of State Road A-1-A and running from the Easterly
boundary of the subject property to the Easterly boundary thereof
upon payment to the mortgagee of a release price of $1,081.00
per lineal foot, provided, however, that the last release shall
not be for less than one hundred (100) feet as so measured.
B) All partial releases of land shall be prepared by the mortgagor
and delivered to the mortgagee's attorney for approval and sub-
sequent execution by the mortgagee. The mortgagor shall pay
for the preparation of the partial releases as well as the
recording of-same. All prepayments made by the mortgagor shall
. be applied toward partial releases and shall be credited to the
final principal payment.
