ORDER
This~cause having come before the Court on December 11,
1980 upon Plaintiffs' Motion for Continuance and Plaintiffs' motion
for a ruling of law from the Court regarding mitigation of damages,
and the Court having heard the-arguments of counsel and having re-
viswed the record, being otherwise fully advised in the premises,_
it is hereby,
ORDERED AND ADJUDGED:
1. Plaintiffs' Motion for Continuance is granted and
this cause shall be set on the trial docket beginning February 2,
1981;
2. The Court hereby rules as a matter of law, upon Plain-
tiffs request, that Plaintiffs' appraiser may not assume a replat
of the remaining existing subdivision on the subject property in
order to mitigate damages to the remaining property of Defendant.
DONE AND ORDERED in Fort Pierce, St. Lucie County, Florida,
