Noodb~~ ~ ~ State of New York , hereinafter referred to as ' rantee . 0 ~i~ That Grantor, for a. ~ DOLLARS and other good ,, receipt of which is hereby Grantee and Grantee's hei~ ~ property situated, lying ~ WITNESSETH: nd in consideration of the sum of TEN (t10.00) and valuable consideration paid by Grantee, the acknowledged, has granted, bargained, and sold to rs and assigns forever , the followinq described real and being in St. Lucie County, Florida, to-wit: 'Fhe Condominium Parcel known as AparUnent 828-A of Phase I of HIGH POINT OF FORT PIERCE CONDOMINIUM SECTION III (the "Condominium") according to the Declar- ation of Condominium thereof ("Declaration") , recorded in Official Records Book 341 at Pages 2403 throuqh2542 of the Public Records of St. Lucie County, Florida as t~ie Declaration may ha.ve been amended by any amendments recorded in the PQ~lic Records of St. Lucie County, Florida including, but not limited to, any amendment to add the aforesaid Phase to the Condominium (if such Phase be other than Phase I thereof). Grantee, by acceptanee hereof, and by agreement with Grantor hereby expressly assumes and agrees to be bound by and to comply with all of the covenants, terms, conditions and provisiQns set forth and contained in the aforedescribed Declaration of Condominium, including, but not limited to, the , obligation ~to make payment of assessments for the maintenance and operation of the Condominium which may be levied against the above-described Apart- ment. Grantee expressly acknowledges the existence of a Settlement Stipula- tion and Agreement for and Grant of Easements and Other Rights• {the "Setde- ment Stipulation") and a Declaration of Protective Covenants and Restrictions (the "Protecdve Covenants" ), as well as the "Designation Notice" modifyinq the Setdement Stipulation and Protective Covenants, all as hereinafter set forth. The Setdement Stipulation provides for this Condominium to be served . by certain facilities of High Point of Fort Pierce Condominium Section 1 and the Protective Covenants provides for certain land use covenants upon the land areas described therein (including, but not limited to, portions of the land areas included within this Condominium) and provides for certain drainage P.asements and other easements and rights including, but not limited to, the "Roadway Easement" ,"Sewage System Rights" ,"k'ater System Rights" and ~L "Future Development Property Drainage Easement" , all as are more particular- ly described therein, all in addition t.o the other matters set forth in the Settlement Stipulation and Protective Covenants , which other matters include , but are not limited to, the obligation to pay certain "Assessments" as are respectively set forth in the Settlement Stipulation and Protective Covenants.
