Book $ y7 , at page ,5 ~, of the Public Records of St. Lucie County, Florida, encumbering the hereinafter described real property situated lying . • and being in.St. Lucie County, Florida, namely, viz: Sou~h West 1/4 of the South East 1/4 of Section 27, Township 34 South, Range 39 East, less and excepting the East 40' thereof and the South 50' thereof, and The North 1540' of the West 1/2 of the East 1/2 of Section 34, Township 34 South, Range 39 East, St. Lucie County~ Florida, less and excepting the North 100' and the East 40'. ~ 3. The foregoing assignment is made as collateral secur-ity for the payment of a promissory note made by Assignors, Sellers, dated . the 20th day of January A.D., 1981, for Forty-Five Thousand Dollars ($45,000.00) to the order of the Broker, Assignee, which, with interest at twelve percent (12$) per annum is due on or before January 20 A.D., 1982. The fractional interest of the mortgage and note described herein shall be reassigned to the Assignors, Sellers, by the Assignee Broker, if the Assignors, Sellers' note is fully paid and discharged at its maturity. Provided further, if the first installment due under the purchase money mortgage assigned is not paid, and the purchase money mortgage is placed in foreclosure, the Broker shall reassign the mortgage fractional interest to the Assignors. If buyer under the referenced contract loses the subject property through foreclosure, assignors shall have no further liability to Broker for balance of commission due as evidenced by the note ~ secured by this Assignment.
