CASE NO. 80-562-CA STATE OF FLORIDA, Petitioner, vs. ONE 1977 Chevrolet Corvette VIN: 1Z37L7S403027; ONE 1975 Cadillac Seville VIN: 6S69R6Q510.913 and ROBERT LIPPNER, Jr., Respondents. / FINAL JUDGMENT THIS CAUSE was heard before the_Court on December 24, 1980 on petition for rule to show cause. The essential facts were stipulated by the parties and no testimony ~as taken. The Court finds as follows: The respondent, Robert Lippner, Jr., was the owner of • two (2) vehicles, a 1977 Chevrolet Corvette and a 1976 Cadillac Seville on March 28, 1980. On that date, Mr. Lippner was involved in a conspiracy to import more than 5,000 pounds of marijuana into the United States. By prearrangement, on March 29, 1980,-Mr. Lippner and another co-conspirator drove in Mr. Lippner's Corvette to the jetties in Fort Pierce, Florida and met with an informant and undercover agent to discuss flying a DC-3 with.marijuana aboard from Columbia to~Florida. The pilot, an undercover agent, and they decided to go see the airplane involved and the landing strip on the next day. This discussion for the conspiracy took place more than one hundred feet from the Corvette. No contraband was in the Corvette and no money exchanged hands in the Corvette. Then, by prearrangement on March 30 or 31, 1980, the pilot met at an airport in Fort Pierce with Mr. Lippner and another co-conspira- tor.
