ORDER
This cause came on for hearing before the Court on
the Counterdefendant's Motion to Dismiss Counterclaim,
and the Court having considered argument by cout~sel for
the parties, and it appearing to the Court that the Counter-
claim fails to allege the date of the taking and further
fails to contain an adequate legal description of the pro-
perty taken, and the Court being fully advised in the
premises, it is thereupon,
ORDERED AND.ADJUDGED that the Motion to Dismiss is hereby
granted with leave to the Counterclaimant to file an Amended
Counterclaim herein within 20 days of the date of this Order,
and the Counterdefendant shall have 20 days after service
to plead thereto. _
