MOTION FOR SUMM~RY JUDGrtENT
This matter came on for hearing before the court upon
Defendant, Sterling Cole's motion for Summary Judgment. The court,
having heard argument of counsel, finds that there are raaterial
issues of fact remaining to be tried. The Affidavits o~ Sterling
Cole and his wife, Stephanie B. Cole could not be considered by
this court, because they were not timely filed. Since there are
material issues of fact remaining to be resolved at trial, Defendant,
Sterling Cole's motion for Sumriary is hereby denied.
ORDERED THIS DAY OF JANUARY, 1981.
