of the public records of St. Lucie County, Floridas and
WHEREAS, a certa~n portion of the land encumbered by the
Mortgage has been conveyed by the Mortgagors to Robert E. Swan
and has been released from the lien and operation of the Mort-
gage by virtue_of.that certain partial release dated December
7, 1979, and recorded on December 20, 1979, in O.R~. eook 322,
at page 1704, of the public records of St. Lucie County,
Florida; and
WHEREAS, the parties hereto desire to modify the terms of
payment of the indebtedness evidenced by the aforementioned
promissory note of Mortgagors.
NOW, THEREFORE, in consideration of the premises and the
mutu~tl covenants hereinafter set forth, the parties hereto
agree as follows:
1. Kenneth L. Neill, Roy L. Neill and James David Neill
hereby represent and warrant that by virtue of that certain
warranty deed dated July 24, 1980, and recorded on August 12,
1980, in O.R. Book 336, at page 1590 of the public records of
St. Lucie County, Florida, they are the owners of the land des-
cribed in Schedule "A" attached hereto and by reference made a
part hereof and that there are no liens or encumbrances against
said lands other than the Mortgage, as modified, and real
estate taxes accruing subsequent to December 31, 1979.
2. David L. Walker represents and warrants that by virtue
of those certain warranty deeds dated July 24, 1980, August 1;
1980, and July 23, 1980, and recorded on August 12, 1980, in
O.R. Book 336, at pages 1592, 1594, and 1596, respectively, of
the public records of St. Lucie County, Florida, he is the
owner of the lands described in Schedule "B" attached hereto
_ and by reference made a part hereof, and that there are no
liens or encumbrances against said lands other than the Mort-
gage, as modified, and real estate taxes accruing subsequent to
December 31, 1979.
