~ That Grantor, for and in consideration of the sum of TEN (t20.00)
~ DOLLARS and other good and valuable consideration paid by Grantee, the
~ receipt of which is hereby acknowledged, has granted, bargained, and sold to
Grantee and Grantee's heirs and assigns forever, the following described real ~
property situated, lying and being in St. Lucie County, Florida, to-wit:
The Condominium Parcel known as Apartment 934C of
Phase II of HIGH POINT OP F'ORT PIERCE CONDOMINIUM
SECTION III (the "Condominium") according to the Deciar-
ation of Condominium thereof ("Declaration"} , recorded in
Official Records Book 341 at Pages 2403 through2 2
of the Public Records of St. Lucie County, Florida as t e
Declaration may have been amended by any amendments
recorded in the Public Records of St. Lucie County,
Florida including, but not limited to, any amendment to
add the aforesaid Phase to the Condominium (if such
Phase be other than Phase I thereof). ~
Grantee, by acceptance - hereof , and by agreement with Grantor hereby
expressly assumes and agrees to be bound by and to comply with all of the
covenants, terms, conditions and provisions set forth and contained in the
aforedescribed Ceclaration of Condominium, inctuding, but not limited to, the
obligation to make payment of assessments for the maintenance and operation
of the Condominium which may be levied against the above-described Apart-
ment. Grantee expressly acknowledges the existence of a Settlement Stipula-
tlon and Agreement for and Grant of Easements and Other Riqhts •~the "Settle-
ment Stipulation") and a Declaration of Protective Coven~nts and Restrict3ons
(the '!Protecttve Covenants"), as well as the "Designation Notice" modifying
the Setdement ~Stipulation and Protective Cover.ants, all as hereinafter set
forth. The Settlement Stipulation provides for this Condominium to be served
by certain facilities of High Point of Fort Pierce Condominium Section 1 and
the Protective Covenants provides for certain land use covenants upon the
land arsas described therein (includin~, but not limited to, portions of the
land areas included within this Condominium) and provides for certain drainage
P.asements and other easements ~ and rights includinq, but not limiied to, the
"Roadway Easement", "Sewage System Rights", "w'ater System Rights" and
"Future Development Property Drainage Easement" , all as are more particular-
ly described ther.ein, all in addition to the other matters set forth in the
Settlement Stipulation and Protective Covenants, which other matters include.
but are not limited to, the obligation to pay certain "Assessments" as are
respectively set forth in the Settlement Stipulation and Protective Covenants.
Grantee expressly acknowledges and assumes the obligation to pay the amounts
assessed against the Apartment under both the Settlemeni Stipulation and
Protective Covenants and acknowledges that "Assessments" under both the
Settlement Stipulation and Protective Covenants against all properties now or
hereafter included within this Condominium in accordance with the above-
described Declaration of Condominium are "Common Expenses" of this Condomin-
ium as provided for in the Declaration of Condominium~.
