WITNESSETH: That Grantor, for and in consideration of the sum of TEN (510.00) DOLLARS and other good and valuable consideration paid by Grantee, the receipt of which is hereby acknowledged, has granted, bargained, and sold to Grantee and Grantee's heirs and assigns forever the following described real property situated, lyinq and beinq in St. Lucie County, Fiorida, to wit: The Condominium Parcel known as Apartment 12? 8-D~f Phase X I V of HIGH POINT OF FORT PIERCE CONDOMINIUM SECTION II (the "Condominium") according to the Declara- tion of Condominium thereof , recorded in Official Records Book ~04 at Pages 1396 through 15p8 of the Public Records of St.~ Lucie County, Florida as such Declaration may have been amended by any amendments thereto hereto filed in the Public Records of St. Lucie County, Florida including, but not limited to, any amendment to add the aforesaid Phase to the Condominium (if such Phase be other than Phase I thereof). ~ Grantee, by acceptance hereof , and by agreement with Grantor hereby expressly assumes and agrees to be bound by and to compiy with all of the covenants, terms, conditions and provisions set forth and contained in ihe aforedescribed Declaration of Condominium, including, but not li~nited to, the obligation ~ to make payment of assessments for the maintenance and operation of the Condominium which may be levied against the aboye described Apart- ment. Graniee expressly acknowledges the existence ~ of a Settlement 5tipula- tion and Agreement for and Grant of Easements and Other Rights ~the "Setde- ment Stipulation" ) and a Declaration of Protective Covenants and Restrictions (the "Protective Covenants"), as hereinafter set. forth. The Settlement Stipu- lation provides for this Condominium to be served by certain facilities of High Point of Fort Pierce Condominium Section 1 and the Protectfve Covenants provides for certain land use covenants upon the land areas described therein (including, but not limited to, portions of the land areas included within this Condominium) and provldes for certain drainage easements and other ease- ments and rights including, but not limited to, the "Roadway Easetnent", "Sewage System Rights" ,"Water System Rights" and "Future Development~ Property Drainage Easement", all as are more particularly described therein, all in addition Lo the other matters set forth in the Settiement Stipulation and Protective Covenants, which other matters include, but are not limited to, the obligation to pay certain "Assessments" as are respectively set forih in Lhe Settlement Stipulation and Protective Covenants .
