The Plaintif£ returned said goods to the possession of the ~efendant alleging that said goods were damaged. The Plaintiff now demands return . of the down payment. 2. The documentary and other evidence listed and presented ; at the Pre-Trial Conference shall be admitted into evidence without objection. That evidence c~nsists of the exhibits to the ~ Complaint and the attached correspondence between the parties. 3.
