The Pre-Trial Con£erence having been held on January I2, ~

ORDERED AND ADJUDGED: ~
1. The parties stipulate and admit the following facts: ~

(a) The Plaintiff has paid to the.Defendant $4,275.00
as a down payment on certain goods and merchandise. The Plaintif£
returned said goods to the possession of the ~efendant alleging
that said goods were damaged. The Plaintiff now demands return .
of the down payment.
2. The documentary and other evidence listed and presented ;
at the Pre-Trial Conference shall be admitted into evidence
without objection. That evidence c~nsists of the exhibits to the ~
Complaint and the attached correspondence between the parties.
3. Those witnesses listed at the Pre-Trial Conference will
be permitted to.testify in this cause and they are as follows: ~
