THIS INDENTURE, made this 24th day o# Decembe~r , 198~, between
HIGH POINT EQUITIES, INC. , a F~Ior~da corporation, hereinafter refer~ed to

WITNESSETH:

Grantor, for and in consideration of the
sum of TEN (t10.00)
' DOLLARS and other good and valuable consideration paid by Grantee, the
4 receipt of which is hereby acknowledged, has granted, bargained, and sold to
~ Grantee and Grantee's heirs and assigns forever, the folloK-ing described real
~ property situated, lying and being fn Si. Lucie County, Florlda, to-wit:
The Condominium Parcel known as Apartment 831c of
Phase Iii of HIGH POINT OF FORT PIERCE~ CONDOMINIUM
SECTION III (the "Condominium" ) according to the Declar-
ation of Condominium thereof ("Declaration") , recorded in
Official Records Book 3" 41 at Pages 2443 through25_42
of the Public Records o~ Si. Lucie County, Florida as the
Declaration may have been amended by any amendments
recorded in the Public Records of Si. Lucie County,
Florida including, but not limited to, any amendment to
add the aforesaid Phase to the Condominium (if such
Phase be other than Phase 1 thereof).
Grantee, by acceptance hereof, and by agreement with Grantor hereby
expressiy assumes and agrees to be bound by and to comply with all of the
covenants, terms, conditions and provisiQns set forth and contained in the
aforedescribed Declaration of Condominium, including, but not limited to, the
obligation to make payment of assessments for the maintenance and operation
of the Condominium which may be levied against the above-described Apart-
ment. Grantee expressly acknowledges the existence of a Settlement Stipula-
tion and Agreement for and Grant of Easennents and Other Rights- (the "Setde-
ment Stipulation") and a Declaration of Protective Covenants and Restrictfons
~the "Protecdve Covenants"), as well as the "Designation Notfce" modifying
the Settlement Stipulation and Protective Covenants, all as hereinafter set
forth. The Settlemeni Stipulation provides for this Condominium to be served
by certain facilities of High Point of Fort Pierce Condominium Section 1 and
the Protective Covenants provides for certain land use covenants upon the
land areas described therein (including, bui not limited to, portions of the
land areas included within this Condominium) and provides for certain drainage
P.asements and other easements and rights including, but ~ot limited to, the
"Roadway Easement", "Sewage System Rights", "Water System Rights" and
"Future Development Property Dr3inage Easement" , a!1 as are more particular-
ly described therein, all in addition to the other matters set forth in the
Settlemeni Si3pulation and Protective Covenants, which other matters include,
but are not limited to, the obligation to pay certain "Assessments" as are
respectively sei ; forth in the Settlemeni Stipulation and Protective Covenants .
Grantee expressly acknowledges and assumes the obligation to pay the amounts
assessed against the Apartment under both the Settlement Sttputation and
Protective Covenants and acknowiedges that "Assessments" under both Lhe
Setdement Stipu2ation and Protective Covenants against all properiies now or
hereafier included within this Condominium in accordanee with the above-
described Declaration of Gondominium are "Common Expenses" of this Condomin-
ium as provided for in the Declaration of Condominium.
