PARTIAL RF.T~EASE OF MORTGAGE LIFN
WHEREAS, HUTCHINSON ISLAND I,IMITED, INC., a Delriware
eorporation authoriz.:d to transact business in the State of Flo~ida, hereinafter
called "Mortgagac," by the followin~ described documents granted and conveyed
unto THE F1RS1' NATIONAL BANK OF CHICAGO, a national banking associat~on,
hereinafter eslled "Mortgagee" and its assigns, the pcemises and property therein
particularly described to secure the psyment of the sum oi money hereinafter
mentioned with interest thereon:
Mortgage given by HUTCHINSON ISLAND WMITED, INC., as
Mortgagor, in favor of THE FIRST NATIONAL BANK OF CNICAGO, as Mortgagee,
duted June 2, 1980, and filed in Official Record Book 332, at Page 1703, in the
Public Recocds of St. Lucie County, Florida, in the originai amount of Twelve
lfillion Seven Hundred Thousand Dollacs (;12,700,000.00), togethec with an
ASSignment of Leases, Rents and Profits recorded in Official Record Book 332, at
Page 1728, and Assignment of Sales Contreets recorded in Official Recocd Book
332, at Page 1735, and UCC-1 Financing Statement recorded .in Offieial Record
Book 332, at Page 1721, all of said documents filed in the Public Records of St.
Lucie County, Florida, and all of said documents recorded on June 5, 1980; and in
addition, a UCC-1 Financing Statement filed with the Seccetary of State, State of
Florida, on June 16, 1980, under File No. 1207244, between said pacties; e~d
WHEKEAS, the said Mortgege has requested the said iNurtgagee to
release the premises and other property hereinafter described, being a part of ~aid
b'lortgage, and.encumbered premises, from the liens and operation of said Mortgage
ar-d other liens;
NOjV, THEREFORE, KNOW YE, that the said Mortgagee, in
consideration of the premises and the sum of Ten Dollars ($10.00) and other good
and valuable considerations to it in ha~~d paid by or on behalf of the said mortgegor
at the time of the execution hereof. the receipt whereof is hereby acknowledged,
does remise~ release, quit-claim, exonerate, and discharge from the lien and
operation of said l~iortgage and other liens referred to above unto the said
~"Iortgagor, its successors and assigns that certain portion of the premises conveyed
by said ~lortgage, and other liens referred t~ above more particularly described as
follows:
Condominium Unit No. ~~ CATAMARAN ll,
PHASE B, a Condominium, according to the
Deelaration of Condominium recorded July 15, 1980,
in Officiel Records Book 334, at Page 2451, of the
Public Records of St. Lucie County, Florida.
TO HAVE AND TO HOLD the same, with the appurtenances, unto the
said Mortgagor, its successors end assigns forever, freed, exonerated and
discharged of and from the lien of said Mortgage and every part thereof; provided
always, nevertheless that nothing herein contained shall in anywise impair, alter or
diminish the effect, lien or encumbrance of the aforesaid ;1+[ortgage and other liens
referred to above on the remaining property of said mortgaged premises, not
hereby released therefrom, or any of the rights and remedies of the holder thereof.
