- BEFORE ME, the undersigned autliority, personally appeared
JAMES J. 61cMILLEN, who first being duly.sworn on oath deposes
and says as follows:
1. Affiant's name is James J. I-icMillen, he is the Publisher
of the News Tribune, division of Florida Freedom Newspapers, Inc.,
and has personal knowledge of the facts stated herein.
2. By agreement for Easement dated September 24, 1970, the
News Tribune was granted an easement by the St. Lucie Vets, Inc.,
a non-profit corporation, over a portion of the above-described
property for a period of ten (10) years and an option to renew
said easement for an additional ten (10) years. Said easement =~
was recorded at O.R. Book 187, Pa~e 1042 through 1045 of the Public
Records of St. Lucie County, Florida.
3. In rtarch, 1980, the News Tribune elected to exercise its
option to renew said easement for an additional ten years and
forwarded to St. Lucie Vets, Inc., an Agreement Renewing Easement,
a copy of which is attached hereto as Exhibit A.
4. Despite the timely.exercise of the option to renew said
Easement, St. Lucie Vets, Inc. has not responded to the forwarding
of such Agreement, despite the fact that the 3~ews Tribune timely
exercised its option.
S. In accordance with the terms of the original Fasement, it
was not necessary to have a formally executed extension but merely ~
to have said option exercised, which the h'ews Tribune did in a
timely manner.
,~6. Affiant, as Publisher and on behalf of the News Tribune,
hereby declares that the Plews Tribune, a division of Florida
Freedom ~ewspapers, has timely exercised its option to extend
said easement for another ten (10) years until Sept~ember 23,
1990.
