It is thereupon
ORDERED AND ADJUDGED:
A. The Counter Claim of Pointe South Builders,Inc., and
Richard Miller is hereby dismissed with prejudice, there
being no evidence having been presented at trial regarding
said Counter Claim.
B. Plaintiffs, Abnor A. Lotsof and Lillian W. Lotsof,
his wife, recover from the Defendants, Pointe South Builders,
Inc., a Florida Corporation and Richard Miller, individually,
actual da~~ages in the amount of $29,5~4.13 and punitive
`damages in the amount of S10,000.00 for a total of
$39,574.13, all for which let execution issue.
C. Plaintiffs, Abnor A. Lotsof and Lillian W.Lotsof,his
:-wife, recover from Defendant, Nora B. Miller, the sum of
~$3,050.00 together with court costs to be determined at a
~later date, for which let execution rest. It i-s understood
that the $3,050.00 is a part of the $29,574.13 shown in
;paragraph B above and if any amount of the $3,050.00 is
recovered it shall serve as a reduction of the amount shown
. .
~in paragraph B above; any amount recovered over $26,524.13
~in paragraph B above shall serve as a reduction-of the
~~53,050.00 provided in this paragraph.

~, D. Counts V and VI of the Amended Complaint are

'dismissed with prejudice. '
~ F. Costs shall be taxed at a later date upon Motion.

~Statute 57.105 is denied.
