the purposes of this Agreement, auch notice shall be deemed to
have bee~ given when placed in the United States mail with
first class postage prepaid. Foxebearance to exercise this
option with respect to any failure or breach of the Borrower
shall not constitute a waiver of such right as to any continu-
ing failure or breach,or any subsequent failure or breach.
Gender may, at its option, collect a late chaxge for any ;

installment of principal or interest which is not paid within ~
five (5) days from the due date, which late charge shall be for

the purpose of reimbursing lender for reasonable expenses
incurred by reason of such late payment. The late charge shall j
not exceed the expenses so incucred and in no event shall
exceed four (4$) percent of the amount of such late payment. '~
In case, after default, the indebtedness evidenced hereby ~

is collected by law or through an attorney at law, or under
advice therefrom, the undersigned agrees to pay all costs of
collection, including a reasonable attorney's fee. Such
attorney's fee and costs shall include but not be limited to
fees and costs incurred in all matters of collection and
enforcement, construction and interpretation, before, duxing
and af ter suit, trial, proceedings and appeals, as well as
appearances in and connection with any bankruptcy proceedings
or creditors' reorganization proceedings.
The remedies of the Lender, as pravided herein or in any
security agreement or other document given as security for the
indebtedness evidenced hereby, shall be cumulative and concur-
xent and may be pursued singularly, successively, or together,
at the sole discretion of the Lender, and may be exercised as
often as occasion therefor shall arise. A default under an ~(~
