O R D E R
This cause came on to be heard before the Honorable William
G. Tye, Acting Circuit Judge, on'the Wife's Motion for Order of
Contempt on January 30, 1981 and the Court having heard testimony
of the partie~ and argument of counsel for the respective parties
and being fully advised in the premises, it is thereupon ~
f
ORDERED AND ADJUDGED as follows:
1. The Husband, Clarence Grzeskowiak, has failed to
comply with the terms and conditions of paragraphs 2 and 6(b) of
the Stipulation and Agreement as incorporated in the Final Judgment
dated December 10, 1980 by reference by failing to make the October
and November mortgage payments and to execute documents necessary
to transfer to the Wife sole title to the 1974 Cadillac and the
1972 Dodge Van, and is in arrears in such payments on the mortgage
in the amount of $ 846.00 as of December 1, 1980.
2. The Husband had ~he ability to make such payments
pursuant to the Final Judgment.
3. The Court determines that the Husband, Clarence
Grzeskowiak, is in wilful contempt of this Court for his failure to
comply with the terms of the Final Judgment_and is in arrears in
his payments to Citizens Federal Savings & Loan Association of St.
Lucie County, Florida in the amount of $ 846.00
