JOHNSON Paqe Four • existence under Clause VII(d) of this Will, shall cease and terminate, and all of the rest, residue and remainder of our property, includinq the property then constituting any trust fund, shall be paid_over and distributed to our daughter, REGINA J. MADAUS should she survive us, and if not, to the living children of our daughter, REGINA J. MADAUS, in equal shares, per capita. CLAUSE IX: Our Trustee shall have all the rights, duties, powers and responsibilities granted to testamentary trustees under the Uniform Principal~and Incaae Law,'Chapter 690, Florida Statutes, and the Uniform Trust Administration Law, Chapter 691, Florida Statutes, as those statutes are pre- sently constituted and as they may be amended from time to time. CIAUSE X: We hereby-exempt and excuse our Trustee from complying with the annual accounting provisions of the Florida Trust Accounting Law, Chapter 737, Florida Statutes; however, our Trustee shall submit an accounting of his adminis- tration of the trust to the income beneficiaries at annual intervals. Such accounting shall show all~receipts and dis- ~ bursements of the trust during the period of the accoun~ing and shall contain a statement of all assets of the trust held at the end of the accounting period. The failure of the income beneficiaries, or their legal representative, to object to the Trustee in writing within sixty (60) days after receipt of the accounting shall constitute the binding approval of such bene- ficiaries. CLAUSE XI: In the event we shall die in a common accident, or upon the death of the survivor, we do then appoint REGINA J. MADAIIS as Executrix of this our Last iRill and Testa- ment, to serve without bond.
